These Terms of Service ("Terms") govern your use of the website www.familygradegravel.app and the services provided by Family Grade & Gravel LLC("we," "us," or "our"). By using our website, requesting an estimate, or hiring us for work, you agree to these Terms.
Services
Family Grade & Gravel provides gravel driveway installation and repair, septic system installation, excavation, property clearing, grading, trucking, and related land services in Mason, Michigan and the surrounding mid-Michigan area. Specific work performed is defined by the written estimate accepted by you.
Estimates are valid for 30 days from the issue date unless otherwise noted. Material costs may fluctuate and we reserve the right to update pricing if delivery is delayed past the estimate validity period. Any change to scope after estimate acceptance is documented through a written change order.
Estimates and Acceptance
Estimates may be approved electronically through the customer portal or in writing. Approval of an estimate creates a binding agreement to perform the described work at the quoted price, subject to the conditions in this document.
A deposit of 20 percent of the project total (capped at $1,000) is typically required to secure a place on the schedule. The deposit is non-refundable once material has been ordered or work has been scheduled.
Site Conditions and Customer Responsibilities
Customer is responsible for:
- Identifying and marking all underground utilities, septic components, irrigation lines, invisible fences, and any other buried infrastructure prior to the start of work
- Calling Miss Dig (811) at least three business days before scheduled excavation
- Providing reasonable site access for trucks and equipment
- Disclosing known hazards including but not limited to wells, septic tanks, drain fields, gas lines, electric lines, and water lines
- Obtaining any permits required by local jurisdictions when those permits are the property owner's responsibility
Family Grade & Gravel is not responsible for damage to undisclosed or unmarked underground utilities or features. We will work with reasonable care, but customers bear the risk of undisclosed conditions.
Weather and Scheduling
Work is subject to weather, ground conditions, and material availability. We will reschedule work that cannot be performed safely or to professional standards because of weather or site conditions. Rescheduling does not constitute a breach of the agreement.
Payment Terms
Final payment is due upon completion of work unless other terms are specified in writing. Commercial customers may have Net 30 or other negotiated terms documented on the estimate.
Credit card payments include a 3 percent processing fee that is disclosed on the invoice. Cash and check payments do not incur this fee.
Invoices not paid within 30 days of the due date may incur late fees and may be referred to collections. Customer is responsible for all reasonable costs of collection including attorney fees.
Workmanship Warranty
Family Grade & Gravelwarrants that work will be performed in a workmanlike manner consistent with industry standards. Specific warranty terms (such as septic system installation warranties) are documented on the estimate or invoice for the relevant project. We do not warrant materials beyond the manufacturer's warranty.
SMS / Text Message Terms
By providing your phone number to Family Grade & Gravel, whether through our website contact form, by phone, or as part of a service request, you expressly consent to receive recurring SMS (text message) communications from us related to your service. These messages may be sent through automated systems.
Message frequency varies based on the stage of your project and the type of service. Customers typically receive 1 to 10 messages over the course of a project.
Message and data rates may apply. Charges are determined by your mobile carrier and plan. Family Grade & Gravel does not charge a separate fee for sending text messages.
Opt out at any time by replying STOP to any message. After opting out, you will receive a single confirmation message and no further texts. You can opt back in by replying START or by contacting us.

Carriers, including but not limited to AT&T, T-Mobile, Verizon, US Cellular, and Sprint, are not liable for delayed or undelivered messages.
We will not share your phone number or SMS opt-in status with third parties for marketing purposes. Full details are in our Privacy Policy.
Limitation of Liability
To the fullest extent permitted by law, Family Grade & Gravel is not liable for indirect, incidental, special, consequential, or punitive damages arising from work performed or services provided. Our total liability for any claim is limited to the amount paid by customer for the specific service that gave rise to the claim.
Insurance
Family Grade & Gravel maintains general liability insurance and workers compensation coverage as required by Michigan law. Certificates of insurance are available on request.
Cancellation
Customer may cancel an accepted estimate before work begins by notifying us in writing. If cancellation occurs after material has been ordered, customer is responsible for the cost of the material plus a 15 percent restocking fee where applicable. Deposits are non-refundable once work has been scheduled.
Family Grade & Gravel reserves the right to terminate a project for non-payment, unsafe site conditions, customer interference, or other material breach. In such cases, customer is liable for the value of work completed to date plus any non-recoverable costs incurred.
Photographs and Marketing
We may take photographs of completed work for portfolio and marketing purposes. We will not include identifying details such as a customer's name or specific address in publicly displayed photos without permission. If you do not want photographs of your project used for any marketing purpose, notify us in writing before work begins.
Governing Law and Disputes
These Terms are governed by the laws of the State of Michigan. Any dispute arising from work performed or services provided will be resolved in the state or federal courts located in Ingham County, Michigan, unless both parties agree to mediation or arbitration.
Changes to These Terms
We may update these Terms from time to time. The version in effect when you accept an estimate or use our services governs that engagement. Material changes will be posted to this page with an updated revision date.
